Spain has implemented key regulations to support environmental sustainability, including the Spanish Plastic Tax. Spanish Plastic Tax Overview 

Introduced under Law 7/2022, effective January 1, 2023, the Spanish plastic tax applies to non-reusable plastic packaging, including items such as disposable tableware, food containers, and plastic wrappings. This tax is calculated at €0.45 per kilogram of non-recycled plastic, with exemptions for biodegradable packaging, items used for medical or hygiene purposes, and exports outside of Spain. Businesses can claim tax reductions by using certified recycled plastic in their products. 

Benefits of Certification 

To qualify for tax reductions, the recycled content in plastic packaging must be certified by an accredited entity under the EN 15343 standard. This certification ensures the traceability and conformity of recycled plastics, providing transparency and compliance with Spanish regulations. Obtaining EN 15343 certification not only helps businesses meet tax requirements but also demonstrates a commitment to sustainability, strengthening partnerships and improving market positioning. 

Who is Liable for the Plastic Tax? 

The tax applies to manufacturers, importers, and distributors of plastic products in Spain. International businesses selling or distributing plastic packaging within Spain must also comply, often requiring a local tax representative. Registration with the Spanish Tax Agency and periodic reporting are mandatory to remain compliant.
